CORPORATE & HIPAA COMPLIANCY

Valley View Retirement Community has implementing a Corporate Compliance Program in the year 2004. There are many laws and regulations affecting our healthcare system. Coupled with very complex reimbursement policies established by insurance companies, Medicare and Medicaid, operating a healthcare institution is more regulated than ever.

For these obvious reasons a Corporate Compliance Program (CCP) is recommended to ensure individuals and organizations meet the legal and regulatory requirements of various agencies and accrediting bodies with strong references to billing fraud and resident abuse.

Every healthcare facility has an ethical responsibility to comply with all laws and regulations. The Health Insurance Portability and Accountability Act of 1996, commonly known as HIPAA, gives healthcare providers more incentive to established programs.

HIPAA relates to the requirements for confidentiality and information security for residents as well as noncompliance issues. It also covers work place practices that may affect resident privacy and confidentiality along with the risks of breaching such confidentiality. HIPAA impacts every provider who participates in the federal Medicare program, the state-operated Medicaid programs, or receives money from any private or public health insurer. Under HIPAA, various governmental agencies have the authority to enforce compliance with health insurance laws. These agencies can investigate our facility for fraud or abuse. The scope of the enforcement may also include civil and criminal penalties for fraud or abuse committed by any public or private organization and those individuals involved.

Most organizations are finding that a corporate compliance program is a philosophy or a way of doing business. It is an ethic that exists on a day to day basis within the organization. The organization, along with its Compliant Officer and committee must continuously keep informed of current laws and regulations that govern its business. Staff education, performance monitoring and taking corrective action must also be done on a daily basis.

Valley View Retirement Community began its HIPAA program in 2003. We began to comply with HIPAA regulations on April 16th, 2003. We have been Corporate Compliant since September 2004. We will, by design, ensure our organization and its employees to be in full compliance with relevant laws, ethical standards and federal reimbursement guidelines as we continue to manage our healthcare facility in its day to day operations.
